These terms and conditions govern your use of our website and outline our terms of business; by using our website, you accept these terms and conditions in full. This is a legally binding Agreement for the provision of services between the Client and the Company. By applying for or receiving services from the Company, you represent and warrant that you are 18 years or older, that you agree to provide true, accurate, current and complete information and that you agree to be bound by the following Terms of Business.
NPP Investments (“NPP”) is the trading name of NPP Consulting Ltd which provides all information and supporting photographs of properties through the listings of our website and emails in good faith. NPP does not warrant the accuracy, adequacy or completeness of any description of the properties nor does it warrant the adequacy or fitness of any property for any particular purpose the Investor might have in mind for it.
2) Licence to use website
Unless otherwise stated, NPP or its licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved. You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions. You must not:
(a) republish material from this website (including republication on another website);
(b) sell, rent or sub-license material from the website;
(c) show any material from the website in public;
(d) reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose;
(e) edit or otherwise modify any material on the website;
(f) redistribute material from this website.

Access to certain areas of our website is restricted. We reserve the right to restrict access to areas of our website, or indeed our whole website, at our discretion. If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password is kept confidential. We may disable your user ID and password in our sole discretion without notice or explanation.

Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up-to-date. To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions relating to this website and the use of this website (including, without limitation, any warranties implied by law of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Please also note, should you receive property brochures from us via email or any other form the figures shown are for illustrative purposes only based on our own research, we urge all investors to carry out their own due

(6) Limitations of liability
Nothing in these terms and conditions (or elsewhere on our website) will exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law. Subject to this, our liability to you in relation to the use of our website or under or in connection with these terms and conditions, whether in contract, tort (including negligence) or otherwise, will be limited as follows:
(a) to the extent that the website and the information and services on the website are provided free-of-charge, we will not be liable for any loss or damage of any nature;
(b) we will not be liable for any consequential, indirect or special loss or damage;
(c) we will not be liable for any loss of profit, income, revenue, anticipated savings, contracts, business, goodwill, reputation, data, or information;
(d) we will not be liable for any loss or damage arising out of any event or events beyond our reasonable control.
(7) Reservation Fees
To reserve a property, an Investor must pay a reservation fee to NPP, or a holding deposit direct to a developer.
By paying the reservation fee or holding deposit, the Investor is agreeing to our Terms and Conditions
NPP reserves the right to return a reservation fee or holding deposit to the Investor for any reason and at any stage of the purchasing process to cancel a sale before exchange of contracts. NPP will not be liable for any losses or costs incurred by the Investor in such a case.
The reservation fee or holding deposit will not be refundable in any circumstances when the Investor cannot complete a purchase, or the purchase is delayed because the Investor is unable to obtain a mortgage, is refused a mortgage or has a mortgage withdrawn. Should an Investor be relying on obtaining mortgage finance the Investor must satisfy all the lender’s terms and conditions, including satisfactory proof of income, availability of deposit and that the source of the deposit is acceptable to the lender. The reservation fee or holding deposit is non-refundable when a mortgage provider refuses or withdraws any mortgage upon an Investor’s failure to satisfy the mortgage provider’s terms and conditions. A reservation fee will not be refunded under any circumstances if an investor takes an unreasonable amount time to complete a purchase of a property and the vendor of the property pulls out of the deal as a result of this. All investors are responsible to organise the funding of any property purchase, although NPP may recommend brokers and solicitors, these are third party companies and should not be construed as part of the same organisation as NPP.
If a sale is aborted through no fault of the Investor NPP may return a reservation fee, NPP shall have a minimum period of 3 calendar months to refund the Reservation Fee (less any fees incurred such as legal fees, valuation fees, administration charges of £199 + VAT and broker fees). NPP will not be liable for any losses or costs incurred by the Investor in such a case. NPP will not be liable for, and will not refund, any legal fees, valuation fees or other fees paid by an Investor or by NPP on behalf of an Investor from any Reservation Fee. All fees are non-refundable once a unit has legally exchanged. Refunds are down to the director’s discretion and a transfer of the reservation fee onto an alternative property may be offered, each case will be investigated individually.
If an investor chooses to pay a reservation fee by any form of credit card (except American Express) a 2.5% fee will apply.
Should any investor go directly to a vendor/sourcing company once introduced by National Property Portfolio and try and purchase the property without National Property Portfolio’s consent, the investor will be liable for our finder’s fee of 3% of the purchase price and any legal fees incurred.
(8) Breaches of these terms and conditions
Without prejudice to other rights under these terms and conditions, if you breach these terms and conditions in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that it blocks your access to the website and/or bringing court proceedings against you.
(9) Exclusion of third party rights
These terms and conditions are for the benefit of you and NPP, and are not intended to benefit any third party or be enforceable by any third party. The exercise of our and your rights in relation to these terms and conditions is not subject to the consent of any third party. If a property is sourced through a third party and or one of NPP’s affiliates, other terms and conditions and fees may apply.
(10) Cancellation Rights
You may cancel your contract with us at any time up to the end of the fourteenth day from the day we have received your Reservation Fee. Any extension of a cooling off period, must be signed off by a director. Should an extension be required as to conduct a viewing of any property, any investor must notify NPP within 24 hours of the viewing taking place whether they wish to proceed or not. Requests for any refunds must be made in writing or via email to our accounts department.
(11) Governing Law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
(12) Entire Agreement
Please note that all of our reservations are subject to a 28 day exchange of contracts. Should any reservations exceed this time period then reservation fees may be forfeited unless prior agreed.
When purchasing properties buyers are advised of the associated risks. Property prices can rise and fall and buying off plan can come with further risks. Buyers are advised to seek legal advice when investing. Properties may be repossessed if you do not keep up to date with mortgage payments.
